Problems with 'too good to be true' HIP providers
The BBC's Watchdog recently covered a report on Home Information Packs and a company that consistently failed to deliver HIPs that had been paid for. The report highlights the importance of using a trusted, reliable HIPs provider rather than those that offer cheap HIPs. In tough market conditions it is easy to see why the cheapest provider might make sense but as the report shows, they can't always be relied on! Hints & Tips - Choose an established provider that has completed significant volumes of HIPs - Ensure your provider is a subscriber to the HIP Code - Get references from existing clients - If it seems too good to be true, it often is view BBC Home Information Pack Report
What is a
Home Information Pack?
A Home Information Pack contains a variety of legal documents about a
property being offered for sale including an energy rating
certificate.
Home owners are required to provide a Home Information Pack (HIP) for
buyers when a property is placed on the market for sale.
Home Information Packs relate to *marketing* of the property by any
method - you don't need to be selling with an estate agent to purchase HIPS
which are available from any authorised supplier.
Buying your own Home Information Pack makes sense
Buying your own HIP has many advantages over allowing an estate agent to arrange your HIP .Owning your HIP means that you are not tied into any deals relating to the sale of your property. Imagine the frustration of employing and under performing agent and knowing you cant go anywhere else owing to the HIP they have arranged. It also reduces the chances of you receiving the best service as you have not had a chance to find for yourself the best HIP provider.
What does
a HIP contain?
The main documents included in the HIP consist of an energy rating
certificate and other documents required to exchange contracts on the property,
it does not contain a building condition survey.
|
Main Documents
- Energy Efficiency Report
- Terms of sale
- Evidence of title
- Standard searches
- Planning consents, agreements, building control
certificates
- Sellers Property Information Form
- Warranties and guarantees
|
|
Leasehold Supplement
- Copy of the lease
- Service charge accounts
- Building insurance policy details and payment receipts
- Regulations made by the landlord or management company
- Memorandum and articles of the landlord or management
company

Aren't
'free' HIPS offered by estate agents?
Take great care, so-called 'free' Home Information Packs are ALWAYS
subject to terms and conditions. Of course, it's not really 'free' at all, the
cost of the HIP must be paid for (by you) at some point, usually by a higher
commission rate on the property sale or a tie in clause, meaning that your
agent 'owns' the HIP and you can't change to another agent if you need
to.
Buying your HIP direct means that you (not the estate agent) own the
HIP and can use it with any other agent or private marketing. It will also be
cheaper than the true hidden cost of an agent's 'free' HIP.
The Little House Company has a special deal for our customers. We
offer a HIP that you own yourself, with no restrictive terms and the freedom to
market your home with any estate agent without penalty. This is not a 'free'
HIP, but is probably the cheapest way to buy your HIP complete and direct. You
can save even more by combining your conveyancing with the HIP.
Exemptions
A Home Information Pack
is required to advertise any property for sale in England & Wales, with
certain exemptions:
- Property not offered on the open market (e.g. direct sale to family
member, neighbour, or friend)
- Non-residential property (i.e. shops or mixed commercial)
- Properties sold with sitting tenants
- homes on the market before HIPS were introduced
From 1 October 2008, all properties advertised for sale must have an
EPC (Energy Performance Certificate), which is included automatically in our
HIPS, but an EPC-only can be ordered separately if the property is exempt from
HIPS.
Energy Performance Certificates:
An EPC must be made
available for any home, free of charge, to a prospective buyer from the 1
October 2008. The requirement for an EPC is not dependent on marketing, but
must be provided during any sale transaction 'at the earliest opportunity', or
where any of the following events happens:
- when the building is viewed (even if that means providing the EPC
before any written information is provided)
- if written information about the building is provided as a result of a
request by a prospective purchaser
- before contracts are exchanged

Procedure
Simply order your HIP at the time of starting your advertising or in
advance by calling 0845 075 7299.
Our HIP providers, LMS, will take all your details and arrange for an
appointment for an energy surveyor to visit your home at a time convenient for
you. All necessary documents will then be compiled to complete your pack
quickly, made available for your buyers to view online or download in PDF
format.
You can track progress of your HIP online. A bound paper copy of the
HIP is available at extra cost. Remember to quote "Little House Company" when
you order.
